TERMS & CONDITIONS

  1. These Terms & Conditions (hereinafter: the “Regulations”) define the rules for providing Digital Services and supplying Digital Content via the Internet for mobile phones, tablets, and computers, offered by GoMobee LTD, registered at Glashaus (Level 3) 263, Triq ix-Xatt, Gzira GZR 1020, Malta.   2. Everyone is required to read these Regulations before using the Service. Use of the Service is possible only upon acceptance of the Regulations.
  3. The Services (defined below) may be used by customers of the networks Polkomtel Sp. z o.o. (PLUS), T-Mobile Polska S.A. (T-MOBILE), Orange Polska S.A. (ORANGE), hereinafter referred to as the “Operator” or “Operators.”
  4. Users are required to use the Service and the Website in compliance with applicable Polish law and in accordance with these Regulations.
  5. GoMobee LTD makes the Regulations available free of charge in a way that allows them to be obtained, reproduced, and stored using the IT system operated by GoMobee LTD, i.e., on the website: https://pl.loovasport.com/
    The Regulations are also available at the registered office of GoMobee LTD.

The following terms used in the Regulations shall have the meanings set out below:

  1. User – an adult natural person using the Service under these Regulations. Individuals with limited legal capacity may use the Services with consent from their legal guardian, and individuals without legal capacity may use the Services through their legal representative.
  2. Digital Content – data produced and delivered in digital form as indicated on the Website. The database of Digital Content offered by GoMobee LTD is periodically updated. The quantity and type of available Digital Content may change over time.
  3. Digital Service – a service that enables:
    a) creating, processing, storing, or accessing digital data indicated on the Website;
    b) sharing digital data indicated on the Website, transmitted or created by the User or other users of the service;
    c) other forms of interaction indicated on the Website using digital data.
  4. Service – paid delivery of Digital Content or Digital Services by GoMobee LTD via the Website at the User’s individual request.
  5. Fee – the monetary amount specified at the time of placing the order, which the User must pay for the Service. The Fee may be one-time or recurring depending on the offer.
  6. Website – the online multimedia platform where the Service is available, at: https://pl.loovasport.com/
  7. Agreement – the service agreement concluded between the User and GoMobee LTD through acceptance of the Regulations and the service description on the Website.
  8. SMS – a text message (Short Message Service) consisting of up to 160 characters (letters, digits, special characters), which can be sent to any mobile phone.
  9. Access Service – a service provided by the Operator according to its terms, allowing Operator subscribers to order paid access to the Service and make payment by being billed on their telecom invoice (postpaid) or by deducting funds from their prepaid balance.
  1. Detailed descriptions of the Services offered by GoMobee LTD, including their prices, are available on the Website.
  2. Due to periodic updates of the Service database, availability and descriptions may change over time.
  3. GoMobee LTD may update and improve the functionality of the Services and Website.
  4. Services on the Website are paid.
  5. Services can be purchased only through the Access Service.
  6. GoMobee LTD may periodically offer promotional Services with terms and availability specified on the Website.
  7. Using the Service requires Internet access. Service Fees do not include data transmission costs, which are charged by the User’s mobile operator.
  8. Services are available in the territory of the Republic of Poland. GoMobee LTD may also offer Services outside Poland, which will be stated in the service description.
  9. Users are entitled to use the Services while temporarily staying in another EU/EEA country, provided their permanent residence in Poland is verified (e.g., through IP address checks and an active Polish telecom contract).
  10. Services used under portability rights during temporary stay abroad will operate on the same terms as in Poland.
  1. Purchasing a Service on the Website through the Access Service is possible in two ways:a) The User enters their phone number on the activation page and clicks “Continue.” The Operator then sends a free SMS with a unique PIN, which the User enters and confirms by clicking “Order and Pay.” or
    b) If the system automatically recognizes the User’s number as belonging to an Operator network, the User can click “Click to accept the Regulations” and then confirm activation by clicking “Order and Pay.”
  2. The Service may be deactivated at any time by sending a free SMS with the text: STOP LOOVASPORT to 80711 (PLUS/ORANGE) or 80713 (T-MOBILE).
  3. The deactivation SMS must be sent from the same phone number used to order the Service.
  4. Deactivation results in loss of access to the Service.
  5. From the moment of activation, access to the Service will automatically renew every 7 days at the rate of 14.99 PLN (VAT included).
  1. The User is charged a Fee according to §4 point 5 of the Regulations.
  2. Fees are collected by the Operators by adding the charge to the telecom invoice (postpaid) or deducting funds from the prepaid balance (prepaid).
  3. Fees are gross prices including VAT.
  1. Use of the Service requires meeting the following technical conditions:
    a) a mobile phone with an active SIM card in one of the Operator networks, able to receive SMS and use the Access Service;
    b) Internet connection;
    c) a device (phone, computer, etc.) with a web browser (e.g., IE 6+, Firefox 4+, Opera 10+, Safari 3+, Chrome) properly configured;
    d) proper data transmission settings.
  2. The User must be authorized to use the devices required for the Service.
  3. Extra information on functionality, compatibility, and technical protections may be provided on the Website.
  4. The User must secure access to their device and account from unauthorized use.
  5. The User may use the Service only for personal use. Copying, reproducing, modifying, publishing, or distributing the Service or its parts is prohibited.
  1. Short service interruptions (up to 5 hours monthly) may occur due to maintenance. Longer issues caused by failures will be fixed as soon as possible.
  2. Service availability may be affected by factors beyond GoMobee LTD’s control, such as weather, poor signal, network failures, etc.
  3. Services may have territorial licensing restrictions and are available only in Poland unless otherwise specified.
  4. Some content is protected by copyright. GoMobee LTD may use authorization or encryption systems. Users may only use the Service for personal purposes.
  5. Services may have technical or licensing limitations affecting device compatibility.
  6. Use of the Service may be restricted if the User attempts to use it on too many devices or unauthorized devices.
  7. Users must not upload unlawful content.
  1. GoMobee LTD is responsible for failure to deliver the Service on time and for lack of compliance with the Agreement.
  2. If the Service is not delivered on time, the User may file a complaint. If GoMobee LTD still fails to deliver, the User may terminate the Agreement.
  3. In case of non-compliance, the User may request correction through a complaint.
  4. The User may reduce the price or terminate the Agreement if:
    a) correction is impossible or excessively costly;
    b) GoMobee LTD fails to correct the issue;
    c) non-compliance is significant;
    d) GoMobee LTD indicates it will not correct the issue within a reasonable time.
  5. Price reduction will be proportional to the degree of non-compliance.
  6. The right to terminate does not apply if the non-compliance is minor.
  7. GoMobee LTD may refuse claims if the User’s device does not meet technical requirements or the User fails to cooperate during verification.
  1. Users have the right to submit complaints.
  2. Complaints may be submitted:
    a) via email: reklamacje@teleaudio.pl
    b) in writing to the GoMobee LTD address.
  3. Complaints must include:
    a) name and MSISDN used for the order;
    b) description of issue, date of occurrence;
    c) User’s signature (for written complaints).
  4. Complaints will be examined within a reasonable time, no later than 14 days in complicated cases.
  5. Responses will be sent by email unless otherwise specified.
  6. GoMobee LTD may request additional information from the User; failure to provide it may result in the complaint being dismissed.
  7. Users may pursue claims in court or, for consumers, in mediation or arbitration proceedings.
  1. GoMobee LTD may amend the Regulations.
  2. Changes not required to maintain compliance may be made for reasons such as:
    a) changes in law;
    b) administrative decisions;
    c) service improvements;
    d) security reasons;
    e) fraud prevention;
    f) technical/functional updates;
    g) new features;
    h) editorial corrections;
    i) administrative data changes.
  3. GoMobee LTD will announce changes on the Website.
  4. Announcements will be published 14 days in advance, if possible.
  5. If a change negatively affects the User, GoMobee LTD will inform the User on a durable medium, 14 days in advance.
  6. Users may terminate the Agreement within 30 days if they do not accept the changes.
  7. The right to terminate does not apply if GoMobee LTD allows the User to continue the Service unchanged and free of extra charge.
  8. Unregulated matters are governed by applicable law.
  9. GoMobee LTD protects Users’ privacy but cannot completely eliminate Internet risks.
  10. GoMobee LTD is the administrator of Users’ personal data. Details are provided in the Privacy Policy.
  11. The Agreement is concluded in the Polish language.
  12. This Agreement is governed by Polish law.
  13. The User has the right to withdraw from the Agreement within 14 days unless the User agrees to Service activation before that deadline and acknowledges losing the right to withdraw.
